Terms & Conditions
By engaging Malik Mayweather for any services, you agree to be bound by the following Terms & Conditions. These terms constitute a legally binding agreement between you ("Client") and Malik Mayweather ("Company"). By booking, registering, or making payment for our services, you acknowledge that you have read, understood, and agree to these terms.
1. Scope of Services
Malik Mayweather provides services including but not limited to:
- Buyer representation and home search consulting
- Seller representation and listing services
- Market analyses and pricing strategy
- Showings, open houses, and negotiations
- Referrals to vetted lenders, inspectors, and service providers
Specific deliverables, timelines, and pricing for each engagement will be outlined in a separate proposal, contract, or enrollment agreement agreed upon by both parties prior to commencement.
2. Payment Terms
2.1 Invoicing & Deposits
Real estate brokerage commissions are governed by a separate listing agreement, buyer-representation agreement, or referral agreement, as applicable. No fees are owed to us simply for visiting this site or making an inquiry.
2.2 Late Payments
Invoices unpaid beyond 14 days of the due date may incur a late fee of 1.5% per month on the outstanding balance. We reserve the right to pause or withhold delivery of services until outstanding balances are settled.
2.3 Cancellations
Termination of any signed listing or representation agreement is governed by the cancellation terms set out in that agreement. Showing appointments cancelled with less than 24 hours' notice may be rescheduled at our discretion.
3. Information & Listings
Property information, market data, and listing details published on our site are provided in good faith but are not guaranteed to be accurate, current, or complete. All information should be independently verified by the prospective buyer or their representative.
4. Third-Party Services
Lenders, inspectors, contractors, and other service providers we may refer are independent third parties. We are not responsible for the acts, omissions, or performance of any third-party provider.
5. Client Responsibilities
The Client agrees to:
- Provide accurate and complete information necessary to complete the services
- Provide timely feedback, approvals, and access within agreed-upon timelines
- Ensure all necessary permissions are obtained for any work to be performed at the property or location
- Communicate any changes to scope in writing prior to additional work commencing
Delays caused by the Client's failure to fulfill these responsibilities may result in revised timelines and additional fees.
6. Updates to Listings & Information
Listings, pricing, and availability may change without notice. We make no guarantee that any property displayed remains available at the listed price or terms.
7. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the engagement. This obligation survives the termination of the agreement. We will not disclose Client information to third parties without prior written consent, except as required by law.
8. Limitation of Liability
Our total liability for any claim shall not exceed the total fees paid by the Client for the specific engagement giving rise to the claim. Malik Mayweather is not liable for:
- Indirect, incidental, or consequential damages
- Loss of revenue, profits, or business opportunities
- Equipment failure by third parties or circumstances beyond our control
- Performance, results, or outcomes on any platform, channel, or market
9. Dispute Resolution
In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If resolution cannot be reached within 30 days, disputes will be submitted to binding arbitration in Miami-Dade County, Florida, in accordance with the rules of the American Arbitration Association. The prevailing party shall be entitled to recover reasonable attorney's fees and costs.
10. Governing Law
These Terms & Conditions are governed by the laws of the State of Florida, without regard to its conflict of law provisions.
11. Fair Housing & Equal Opportunity
We comply with the Fair Housing Act and all applicable federal, state, and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex, handicap, familial status, national origin, sexual orientation, or any other protected class.
12. Modifications to Terms
Malik Mayweather reserves the right to update these Terms & Conditions at any time. Material changes will be communicated via email or posting on our website. Continued engagement with our services following notification constitutes acceptance of the revised terms.
13. Entire Agreement
These Terms & Conditions, together with any applicable proposal, contract, or enrollment agreement, constitute the entire agreement between the parties and supersede all prior discussions, representations, and agreements.
